2. Submitting a DMCA Notice
If you believe copyrighted material available through BLKWORX TV infringes a copyright that you own or are authorized to enforce, send a written notice to the registered designated agent listed above. A notice should substantially include:
- A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed or, when multiple works are covered by one notice, a representative list of those works.
- Identification of the material claimed to be infringing and information reasonably sufficient for BLKWORX TV to locate it, such as the title name, page, or URL.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, the owner’s agent, or applicable law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Do not include unrelated confidential information, passwords, full payment-card numbers, or other sensitive credentials in a DMCA notice.
3. BLKWORX TV Response to a Notice
Upon receiving a substantially compliant DMCA notice, BLKWORX TV may act expeditiously to remove or disable access to the identified material and may take reasonable steps to notify the creator or other party responsible for providing the material. BLKWORX TV may forward the notice, including the complainant’s contact information, to the affected creator or rights holder as reasonably necessary to administer the DMCA process.
Removal or disabling of material in response to a notice is not an admission by BLKWORX TV or the submitting creator that infringement occurred. BLKWORX TV may request additional information when a notice is incomplete or does not reasonably identify the work or material at issue.
4. Counter-Notification
If material is removed or disabled because of a DMCA notice and the affected creator or provider believes the removal resulted from mistake or misidentification, that person may submit a written counter-notification to the registered designated agent. A counter-notification should substantially include:
- The person’s physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
- A statement under penalty of perjury that the person has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- The person’s name, address, and telephone number.
- A statement consenting to the jurisdiction of the appropriate federal district court as required by 17 U.S.C. § 512(g)(3), and accepting service of process from the person who submitted the original notice or that person’s agent.
After receiving a compliant counter-notification, BLKWORX TV may provide a copy to the original complaining party and may restore the material not fewer than ten (10) and not more than fourteen (14) business days after receipt unless the designated agent first receives notice that the complaining party has filed an action seeking a court order to restrain the allegedly infringing activity.
5. Repeat Infringers
BLKWORX TV maintains a policy providing for the termination or restriction, in appropriate circumstances, of creators or users who are determined to be repeat copyright infringers. BLKWORX TV may also remove or disable access to material where it becomes aware of circumstances indicating infringement, subject to applicable law and the facts of the matter.
6. Misrepresentations
Knowingly making material misrepresentations in a DMCA notice or counter-notification may result in liability under applicable law. Before submitting a notice, the complaining party should consider whether the disputed use is authorized by the copyright owner, its agent, or applicable law, including any potentially applicable limitation or exception.
7. Privacy and Recordkeeping
DMCA notices and counter-notifications are legal communications. BLKWORX TV may retain them as compliance records and may disclose relevant portions to the affected creator, complainant, legal counsel, service providers, courts, law enforcement, or other parties where reasonably necessary to administer the copyright process or comply with law.
8. Copyright Questions
Questions concerning BLKWORX TV’s copyright procedures may be sent to info@blkworxtv.com. Formal DMCA notices and counter-notifications should be directed to the registered designated agent using the complete contact information shown above.
