BLKWORX TV is a division of BlkWorx Productions LLC. These Terms of Use (“Terms”) govern access to and use of the BLKWORX TV website, installed progressive web application, streaming services, viewer features, and related services (collectively, the “Service”). By accessing or using the Service, you agree to comply with these Terms to the extent applicable to your use of BLKWORX TV.

1. Access to BLKWORX TV

Certain content may be available without creating an account. Other features, including paid rentals, personalized viewing functions, creator tools, or account-based services, may require registration or additional information. BLKWORX TV may add, modify, suspend, restrict, or discontinue features, titles, or portions of the Service where reasonably necessary for licensing, security, technical, legal, operational, or business reasons.

2. Eligibility and Age

A user must be at least 13 years old to independently create an account. A person purchasing or authorizing a paid rental must be at least 18 years old or the age of majority in that person’s jurisdiction. Parents and legal guardians are responsible for supervising minors who use the Service through a household device or account and for determining whether particular content is appropriate for them.

3. Accounts

If you create an account, you are responsible for providing accurate information, maintaining the confidentiality of your credentials, and taking reasonable steps to prevent unauthorized use. You may not impersonate another person, access another person’s account without authorization, share credentials in a manner intended to defeat platform restrictions, or use BLKWORX TV for fraudulent or unlawful purposes.

4. Content Availability

BLKWORX TV may include content owned by BLKWORX TV and content licensed from independent creators or other rights holders. Availability may change because of licensing periods, creator distribution arrangements, technical issues, legal requirements, or other circumstances. The appearance of a title on BLKWORX TV does not guarantee indefinite availability.

5. Limited Personal Viewing License

Unless BLKWORX TV expressly states otherwise in writing, content is provided solely for personal, non-commercial viewing. Access to a title does not transfer ownership or intellectual-property rights to the viewer. Users may not reproduce, screen-record, download except through an expressly authorized feature, redistribute, rebroadcast, publicly exhibit, sell, sublicense, copy, circumvent access controls, or otherwise commercially exploit BLKWORX TV content.

6. BLKWORX TV Intellectual Property

The BLKWORX TV name, branding, platform design, software, graphics, original programming, promotional materials, and other BLKWORX-owned materials are protected by applicable intellectual-property laws. Independent creator content remains subject to the ownership rights and licenses established between BLKWORX TV and the applicable creator or rights holder.

You may not interfere with platform security; attempt unauthorized access; introduce malicious code; scrape or systematically extract content or account data; manipulate rental access; bypass geographic, technical, or payment restrictions; misuse creator or viewer information; or use BLKWORX TV in violation of applicable law.

8. Rentals and Payments

Paid rentals are governed by these Terms and the BLKWORX TV Rental Terms, which are incorporated by reference. Unless otherwise stated for a title, a rental provides 30 days of access beginning when the purchase is successfully completed - not when the viewer first begins playback. Pricing is displayed before checkout. Applicable taxes or legally required charges may be added where required.

A rental may be accessed on compatible devices, but unless BLKWORX TV expressly states otherwise, only one active stream of the same rental may be used at a time. If a rental charge is disputed, reversed, or subject to a chargeback, BLKWORX TV may temporarily suspend access to the affected rental while the payment dispute is reviewed.

9. Third-Party Services

BLKWORX TV may rely on third-party services for video delivery, payments, hosting, email, analytics, security, and other functionality. Use of some third-party services may also be subject to those providers’ applicable terms and privacy practices.

10. Suspension or Termination

BLKWORX TV may restrict, suspend, or terminate access where reasonably necessary because of fraud, unauthorized distribution, security threats, payment abuse, repeated violations of these Terms, legal requirements, or conduct that materially harms the Service, its creators, or its users.

11. Service Availability and Disclaimers

BLKWORX TV endeavors to provide a reliable streaming experience but does not guarantee that the Service will be uninterrupted, error-free, or available on every device, browser, network, or location. Streaming quality may depend on your equipment, internet connection, browser, device settings, and third-party infrastructure. To the maximum extent permitted by applicable law, the Service is provided on an “as available” basis.

12. Limitation of Liability

To the maximum extent permitted by applicable law, BLKWORX TV will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Service, loss of data, loss of profits, or unauthorized access caused by circumstances outside BLKWORX TV’s reasonable control. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

13. Changes to the Service or Terms

BLKWORX TV may update these Terms as the Service changes. The current version will display an effective date or version. Continued use after an updated version becomes effective may constitute acceptance where permitted by law. Where additional notice or affirmative consent is legally required, BLKWORX TV will provide it.

14. Governing Law and Informal Resolution

These Terms are intended to be governed by the laws of the State of Connecticut, without overriding mandatory consumer protections that apply based on a user’s location. Before initiating a legal proceeding concerning the Service, users are encouraged to contact BLKWORX TV so the parties can attempt to resolve the issue informally. These Terms do not currently include mandatory arbitration or a class-action waiver.
